What Fencing Contractors and Stockists Need to Know

The UK Health & Safety Executive (HSE) has confirmed the renewal of creosote under the GB Biocidal Products Regulation.

The 7-year renewal to March 2033 is a sunset extension, not a long-term endorsement. For the fencing industry, this is a significant shift. Creosote is now a restricted, specialist-use product, and for standard domestic fencing the use of creosote-treated timber will no longer be permitted.

  • Creosote approval extended until 31 March 2033
  • From 1 April 2027, use is restricted to:
    • Transmission poles
    • Railway sleepers
    • Safety-critical fencing applications only (BS8417 Factor D)

What is Safety-Critical Fencing (BS8417 Service Factor D)?

BS 8417 is the British Standard that guides how treated timber can achieve a desired service life, linking real-world decay risk to the level of protection required.

Service Factor D is the highest risk category, it applies where timber is exposed to severe conditions or critical for safety requirements, and requires the highest level of durability and performance.

In simple terms: This is not general fencing. It applies to applications where fencing failure could pose a safety risk, cause infrastructure disruption or have major financial or legal consequences and typically applies to roadside boundary fencing, infrastructure asset protection fencing, and livestock fencing in high risk areas.

What this Means for Fencing Contractors

For standard non-critical fencing, creosote is no longer approved for use. These restrictions include use on domestic and general commercial fencing applications. While creosote remains permitted for safety-critical fencing, its continued use is subject to risk mitigation measures, including:

  • Restrictions on use near watercourses
  • Requirements for storage of posts on impermeable hard standing ground or under shelter
  • Public access - requirement for location specific risk assessment
  • Worker safety requirements, including:
    • Mandatory PPE, including chemical-resistant gloves and impermeable coveralls
    • Access to cleaning in case of skin contact

Most creosote-treated fencing stock will become non-compliant by April 2027, with only specialist categories remaining valid. This means stockists must take clear action by segmenting their inventory into safety-critical and general-use products, ensuring all items are correctly labelled with restricted-use declarations, and avoiding the supply of creosote for non-approved applications. Stockists also need to consider storage as creosote treated timber must be stored on an impermeable hard standing or under shelter.
